The first law was challenged by a NY Mayor, how he got standing I have no idea, and the Supremes voted 6 to 3 that the law giving the line item veto was unconstitutional. True they can try to rewrite the law, but it could still suffer the same fate. As much as I hate wasteful spending, there is no guarantee that that's what a President would use the law for. He could use it as a means to reward and punish Senators and Congessmen that refuse to bow down and worship the President.
