"True they can try to rewrite the law," They did rewrite it. This is a new proposal for law. "... but it could still suffer the same fate." Also true. (Though several legal experts believe it might pass constitutional muster now.) "As much as I hate wasteful spending, there is no guarantee that that's what a President would use the law for." True again. (But we know how Congress views their earmark privileges now.... so the proposed Line Item Veto law might not pass anyway.)
