The handful of former military who have signed on with Obama will, if this happens, have a choice to make. What will it be?

There is the slight matter of the US Constitution, whose Article III, if memory serves, declares that the Supreme Court enforces the law of the land. I don't believe that the Senate has any right to give away the Supreme Court's jurisdiction via treaty. Doubtless Obama has his own views on the subject, Constitutional law being his forte.
