Its not like this factor suddenly kicks in at 21%. It may accelerate at around that point, but its a factor at lower levels as well.

I would agree. There is most likely a minimum effective government below which the lack of predictability becomes a drag on the economy. We can look at most of the states in anarchy and see verification of that.
