For sure that happens. I know for a fact that it has happened in the past on E-BAY and that the perpetrator was never prosecuted. They were not able to prove fraud vs. a poorly run business. In other words, did they intend not to ship or did the business just go BK because it was run so poorly? Civil suits were pointless as the money was gone and there were no assets to put a lien on.

Which is why you should always buy from somebody who has been in business for 10+ years. It still can happen, but at least you can lower the odds as much as possible...
