Mark to market forces banks to declare themselves insolvent when they don't need to be, if they are only allowed to wait for a while.

Shouldn't be that hard to calculate. The Fed now has a fairly decent handle on the various failure rates within the mortgage "sausages" the banks hold. Calculate from there, and let the banks figure on that.
