Under the American legal system it is EASY to file Court cases.

Anyone can do it... happens every day.

(But just because a case may be highly likely to be *filed* --- even if just for purposes of PR --- doesn't in any way imply that said case will ever be successful. <g>)

Now, as to: "The courts are falling down on their duty when they allow such ex post facto taxes."

I completely agree with you on this!

By my reading of the US Constitution, the American legal system has been derelict in upholding the clear Constitutional prohibition or ex-post facto laws for MY ENTIRE (& LONG) LIFE!

(So... I did not mean to suggest that this proposal might not be a violation --- merely that it would be but one of MANY since World War II... and entirely consistent with all the other violations that have been upheld by the Courts.)

So --- although you and I say it is unconstitutional --- the federal Courts have ruled against us for many decades now... and I fully expect that this time would not be any different.
