And... I also accept these two other propositions:

1) For a Constitutional Republic to function properly, there must be *some* final arbiter of "what is constitutional" and what is not.

2) So, obviously... appointments to the highest court in the land (and the federal courts that function as a 'feeder system' to funnel cases to the court of last appeal) matter.
