We know for a fact that Intel offered such a discount schedule to Sony. Or, at least, the JFTC made the claim and produced heavily redacted documents that seemed to indicate such and Intel only disputed that such was illegal, not that it didn't happen.

This heinous crime resulted in a fine of $15,000. Obviously the JFTC didn't see this as the major crime some would like to portray it as, but instead a very minor technicality or misinterpretation of the regulations and asked Intel to make minor changes to it's practices. To characterize this as a crime, in light of Japanese culture and Intel's reluctance to involve it's customers by asking them to testify, is frivolous and trite at best.

Again, volume discounts are not, in fact, illegal. I'm sure you can come up with
some hypothetical case ... but .. that's all it is. Offering a reduced price based
on purchased volume is common in every industry and especially in the semiconductor
business.
