I'm not sure of any GPS-enabled units... perhaps. But I don't think that is true for any cell phones (that they are powered up when they are OFF).

I'd expect that to be mentioned on cop shows, for one thing (e.g. Law and Order) but so far no such mention. The telltale sign would be your battery running down pretty quickly with the phone off versus when the battery is removed.

I suspect there's confusion because of events like this, e.g. a stalker around Seattle planted a phone in his ex-wife's car, and he could monitor her conversations without her knowing it. It was ON the whole time, but was set to auto-answer and silent ring. Nefarious... and highly illegal. But it almost seemed as if he was turning on the phone remotely.
