No, they'll need quite a bit more than that, because in a court of law, you need to PROVE that harm has been done. Even Jackie Childs from Seinfeld needed Cramer to show the coffee burns on his skin in order to have a case (which disappeared after using "the balm").

The law is fairly well defined, and short of the OEMs themselves taking the stand, I don't think any "expert" testimony from Neal Nelson, Dan3, or anyone of similar ambiguous credibility is going to count.
