Yes, that is weird, isn't it?

And this is only an examination of the laws of one state. The legal protections offered by civil unions vary state by state, and may differ from those offered by marriage in specific states.

Since 40 states don't offer civil unions, there is no justification for saying that gay marriage is unnecessary because they already have civil unions.
