It's no different than a library that refuses to carry any book that hasn't been reviewed in the New York Times; the library's purchases are clearly linked to NYT reviews, but the NYT isn't offering anything more than their opinion on the books, good or bad, not a specific buy or sell recommendation.

That's why ratings agencies use terms like positive and negative instead of buy and sell. They are simply guessing at future creditworthiness. What you do with their guesses is your business.
