It seems controversial so I'm not willing to challenge it either way without more to go on and I am not aware of it having been put to the test.

There is no doubt that the AG of the US classified it as legal to be used in interrogation and not torture during Bush's Administration. So, Shep's allegation that Bush admitted to authorizing torture is just plain false.
