Since no U.S. law sanctions water boarding as a punishment, that clause clearly does not apply...

Incorrect as usual...the use of this interrogation method was specifically authorized in certain cicumstances by Executive Order...

So neither, less nor myself nor the Admin. endorsed or condoned "torture" as was alleged.
