Zero percent chance of this. As Megyn Kelley so astutely pointed out today, the Left is trying to re-write the law THEY MADE shortly after 9/11 -- and they're doing it for political gain. This will not stand scrutiny in the Supreme Court. It is doubtful even an extremist like Ginsburg would support such a conclusion. What we're dealing with here is not the law; it is 100% about politics.
