"I believe our FOUNDERS believed the Constitution should be a "malleable" instrument."

You are absolutely correct!! Good call!

All it takes is an amendment to the Constitution. But an amendment is a bit different than one or a few judges remaking law from the bench.

I sure am glad that we have at least four guys on the "Big Bench" that understand that.

I believe our FOUNDERS believed the Constitution should be a "malleable" instrument.

That is why they allowed for Amendments to the Constitution. Prior to the twentieth century it was customary to restrain changes in the meaning of the Constitution to the Amendment process. We can only hope that this lesson is not lost on a majority of the Justices. Right now four seem to, and I'll bet that none are on your list of favorites.

The "Framers" said that blacks were not people, but "property".

The framers preferred having a unified country to having 13 independent states that might be two weak individually to remain independent. Neither the constitution, not the early Articles of Confederation, would have been ratified if they outlawed slavery.

I believe our FOUNDERS believed the Constitution should be a "malleable" instrument.

Yes, its called the amendment process.
