I agree with your post. Intended that your #9 would be part of #1.

I would disagree only to some extent in free market principles although I do agree with the tenor of what you said. For example, I don't believe that funds and institutions should be allowed to lend out shares, but I might consider a disclosure that is not in fine print.

It would go something like this,

"We hold your retirement funds. If we decide that the return on your investment may be increased by lending out shares to those who may short the shares you own, we may do so. Although this is not our intent, this may result in lower share prices for the shares in your portfolio. There is also an inherent conflict of interest as we need to show that we are actually doing something to earn our fees."

I'm not sure if many would invest with this fund or institution, but you get my point.
