Apparently, in the case of this judge empathy beats objectivity. The Prez gets what he wants.

One reason the SC accepted the case was that the 3 member panel of the 2nd Circuit of which Sotomayor was a member adopted the district court judge's ruling without adding their own analysis of the constitutional claims involved. None of them wanted to tackle it - why? Because it was a complex and difficult case? Because it was going to be politically incorrect and hurt their future careers? Because they just wanted to vote "present"? I would be very surprised if this issue did not come up in SC hearings, unless the Republicans decide to fold, which is possible.
