What is definitely not a fact is that "equality exists." If the law applies exactly the same way to both, that is equality, in the sense of equal treatment. Whether its fair, or reasonable, or a good idea, or good policy, is another question. Equal treatment under the law is satisfied by having the law apply the same way to everyone. That doesn't mean that the law doesn't wind up helping or hurting one person more than another. But if the law and government policy where not allowed to hurt or help anyone more than anyone else, you basically couldn't have a government.
