hell if the Rule of Law and not 'empathy' was used in the Dred Scott decision we might not of had a civil war

As a minimum, I would like the republicans on the committee to ask her to explain some of the statements she has made; some of her judicial decisions; and her current views on how a justice should use and view the Constitution as part of reaching a decision in a case before her. They need to get into the Obama philosophy thing about empathy versus the rule of law.

They need to ask her if she can be fair and impartial to white defendants, esp. if they oppose minority interests, and bring up the firefighters' reverse discrimination case.

Matter of fact, the more times the word "impartial" comes up, the better. Americans understand that at the end of the day, judges need to be impartial. The proper use of empathy is to make sure that you don't see the circumstances of one party only, but of both, even when they are of different backgrounds. But then justice must be impartial.

Ye shall not respect persons in judgment; but ye shall hear the small as well as the great; ye shall not be afraid of the face of man; for the judgment is God's: and the cause that is too hard for you, bring it unto me, and I will hear it.
