To give something that is "equal" that is really not equal- But it is really equal. Its identical so its equal by definition, even if its not fair. It isn't in any way cheating. Its as equal as it can be. If equal treated was the only important consideration there wouldn't be any issue to complain about, but clearly both in that situation, and in general equal treatment isn't the only important consideration. It might be reasonably argued that other ideas and considerations where more important than equal treatment, and by focusing just on equal treatment we ignore what really matters.
