It is as equal as "separate but equal".

It may be as just as separate but equal (in practice thus being unjust), but its far more equal. Even if separate but equal was a serious attempt to make things equal (and it almost always was not), the separateness is itself a difference. But I'm talking about treatment that's identical, you can't get more equal than that. Within the point under consideration its perfect equality. Its a basic logical and mathematical principle. A=A.

Of course if you give a 70 lb child and an NFL defense tackle the same amount of heavy lifting to do, your also treating them identically/equally. "Equal" doesn't imply that your treating people the right way, or even that you avoiding abuse or injustice.
