Judges, at least at the highest levels, pretty much do have unlimited power. They don't always exercise it- but they have found interesting "rights" to aid the disenfranchised on the path to equality- the commerce clause cases, the right to privacy- I have no doubt something can be found at the federal level to help the gay community on its way toward true equality (that equality which actually manages to contain some fairness)- because many state judges have already so found.
