all of us use empathy

I agree, Cny, at least to some degree we do, which is why I dislike the word being brought out as if it were something either extraordinary or unique. Her particular experiences may bring a unique viewpoint to the table, a balance I can appreciate in conjunction with the views of the other justices, but standing alone, is she anymore empathetic toward those outside her own experiences than others? WHich I guess is what you meant by selective empathy- great phrase, by the way.

As I said, it isn't the quality I am opposed to! It's this - to me- peculiar emphasis on it. Some news channel had a story yesterday with quotes from white male judges making similar kinds of statements about "feeling" and "empathy".

I prefer the brilliant mind as the prime consideration, leavened with compassion, and with the goal of balance on the court.

But mostly, I just think it gave the RW to run with an exaggerated version of the "feelings" vs. competence theme.
