I don't doubt that she adheres to the law above empathy, even if she is but a woman. However, I would check closely the rulings she has made while on her period and see if a pattern of overemotional or angry or confused decisions can be discerned that should rule her out.

on a more serious note (?), you spelled out the meaning of empathy and its relevance to the application, indeed at times crafting, of the law, very well... I was at a loss how to word it.

I'm looking at her statements not her judgments. If I saw strong clear evidence in her judgments, than I wouldn't say "its not at all clear that it really is an issue of no major concern", I would rather have said "it is an issue of major concern".
