Are you suggesting that white male judges are not capable of rendering a fair judgement in sexual or racial discrimination cases?

You don't need to be able to relate to a situation from personal experience in order to be a good judge.

In fact, such emotional overlay can detract from a judge's ability to be impartial.

Impartiality and fairness are the hallmarks of appropriate judicial temperament in my book.

In fact, what Obama and Sotomayer advocate is the judicial equivalent of jury nullification because it is a rejection of the rule of law in favor of emphathy.

Maybe the Court needs to be reconfigured and the way it decides cases changed. We could have, for example, a hispanic woman to decide issues pertaining to latino girls, an hispanic male to decide issues pertaining to latino boys, same for blacks, a GLBT justice to decide gay, lesbian, bi-sexual and transgender issues, etc.

Would that accommodate your concerns that a bunch of old white guys can't relate to the experience of minorities?
