You seem to be attributing a statement to me that I didn't make. The phrase comes from the piece I quoted, which analyses one hundred, not four decisions involving claims of discrimination in which she participated.

You have stated on several occasions that her stated capacity for 'empathy' with (in particular) those who share her hispanic background is a problem with her nomination.
The cited cases would seem to provide reasonable data with which to test you assertion - which as far as I can tell (as you have failed to provide any supporting evidence at all) - is based on a selective quote from a single speech she made nearly ten years ago.

I'd be interested in your explanation of how you reconcile you serious concerns about her putting empathy above the law with her dissent in Pappas v. Giuliani, 290 F.3d 143 (2002).
