fireman may have been in the right morally, but without legal recourse given the separation of powers and state and local rights. You are dead on--overturning Ricci would have her as an activist judge. She showed good sense in her decision especially by not commenting. She felt her hands were tied. Now lets see what "activist" Scalia and co. will do upon review. Scalia is half bad. Can you imagine if bork was on the court determining originalist intent of framers re: affirmative action. Hell framers said blacks were only 3/5th human.

Plus, she was one of a panel of three judges. I don't think she could have overturned the ruling on her own without the consent of the other judges.

That's what dissenting opinions are for.
