The statement Alito made is quite a bit different than the one Sotomayor made...

Yes, but as an attorney you know perfectly well how the US Circuit Courts of Appeals work. Attorneys pick venue for certain kinds of cases because certain circuits have reputations and cultures. The 4th is a genteel, southern circuit. The 2nd is a wide open, throw it all on the table circuit. They have "made law" for a hundred years and everybody knew it....leaving it to the SC to settle them down. The 9th circuit is a liberal nuthouse.

Sotomayor's comments get the usual wink and a nod from practicing attorneys. Real life. Sure she should have been more circumspect and chosen better words as any "wise lataina" should know. <g>, But disqualifying? no....

A review of her decisions on business cases (much more interest to me) reveals a pragmatic judge with a pretty keen mind and no perceived bias toward a defendent business or plaintiff grievants.

I'm sure in her confirmation hearings she will take the Roberts and Alito approach and ssy little of substance and dance the senators around.
