If you are going to use that context as a starting point, legislation can start from any point where existing law is viewed as inadequate, from the lowest street urchin to the highest court in the land. This may often be the case when the hammer of justice is heard but that doesn't change the role of judges to be legislators. Our checks and balances system has served us well in most case up to now. Let's keep it that way. True. However, I suspect a healthy portion of our laws come from interpretations the courts make when ruling on cases.
