They are the ones who determined the 17 aren't terrorists or have committed crimes against us. There have been many enemy combatants killed who "committed no crimes against us", but were killed solely because they were fighting. These people were terrorists. We were at war against all terrorists. Hence, they were fair game. I've never seen any indication from the Pentagon that they believed these terrorists should be released, which is what Obama just did.
