Maybe you didn't get four justices who thought there where serious constitutional issues (or at least serious enough to put on their case load which is kept smaller than it was in the past). That doesn't imply there where not serious problems with the case.

Well, according to the decision, they say the plaintiffs weren't able to make the case that it should be reviewed. Which is almost the same thing, but not quite.
