My practice involves a lot of Senior Citizens and many are not making it out of the Hospital. I would not allow a relative of mine over 70 to have elective surgery. The hospitals are killing them like flies.

You might have a hard time suing the government, but you can surely sue the doctors here in Canada. Its been done many times, even though Canada is not nearly as litiguous as the US generally.
