You're contradicting yourself. The "equal protection" argument is being used to counteract the definition of marriage as determined by popular vote.

Besides, why have any gender-specific laws on the books if that by itself violates "equal protection"? I hear this one lawyer sued the Oakland A's because the free gift given to women during a breast cancer awareness event was "discrimanatory."

Guess what? That lawyer won.
