I don't object to the outcome but Sonameyor was on the Court of Appeals - not the Supreme Court. A judge on the Court of Appeals should follow precedent and not try to make new law.

No, they used that as an excuse. The Right Reverend insisted the test be dumped or he would sue ;^)

You can't just assume disparate impact, but that seems to be what the hiring authority did.
