Apparently that is allowed in certain cases.....so until you know what the details of the program are and Cheney is found guilty.....after he is charged and all that due process stuff, you really don't have a reason to be building the gallows yet.

"But the language of the statute, the amended National Security Act of 1947, leaves some leeway for judgment, saying such briefings should be done “to the extent consistent with due regard for the protection from unauthorized disclosure of classified information relating to sensitive intelligence sources and methods or other exceptionally sensitive matters.”"

Oh bummer! Me thinks Cheney besides being vice president was Bush's unannounced czar of foreign affairs and covert operations. Being a czar in these areas he wasn't under congressional supervision for these areas where he was czar.
