Because they are not treated as domestic criminals. They are treated as battlefield enemies...still doesn't mean you can violate international agreements of warfare behavior.

Is Congress informed in advance every time Obama lets a drone fire into a Pakistani village? Of course not. Was Congress advised of Clinton's authorization of assassination attempts on AQ leaders? Clinton admits he "tried to kill" Osama.

Don't change the subject...I am sure congress is informed that drones are being used to pursue AQ...but then the fundamental issue is not that is it? It is in fact that the VP, a member of the executive branch, is mucking around telling the intel community to keep in the dark another branch of gov with the legal right to be briefed...

Actually the Obama adm has decided they can. But if Bush were President, liberals would be going batty over this:

They have established a legal procedural end game...the president retains the right to set aside a verdict, but he hasn't...and until he does and until we review the reasons he might, then we ought to give the folks working on this a chance to get their work done.
