The Fifth Amendment right against self incrimination would not apply. The documents could be supoened directly from the State of Hawaii. Also this a civil and not a criminal matter. Can you vizualize the Presdident claiming the Fifthe. It would practically be an admission that he was a criminal. Even if pleading the Fifth were a good legal tactic, it would be a disaster politically.
