Oh please. Except for Harriet Miers, whose qualifications were almost entirely based on personal relations, W by all indications considered everyone who toed the dogmatic Federalist Society line. That and age disqualified your hero Posner for W.

I wonder if you see the irony in your bringing the founding fathers into a discussion on racial/gender diversity, considering that the constitution they drafted defined colored slaves as 3/5 of a person, not to mention denied the vote to women.

As for your assertion that no white man was considered for the SC:

[the] short list of about six names for President Obama’s Supreme Court pick. The co-frontrunners (in no particular order): Diane Wood of the 7th Circuit, Solicitor General Elena Kagan, Sonia Sotomayor of the 2nd Circuit, Michigan Gov. Jennifer Granholm, Homeland Security Secretary Janet Napolitano and Merrick Garland of the DC Circuit Court of Appeals. Obviously, folks can slice this list all they want: Five are women; one’s Hispanic; one’s male; and all are in their late 40s or early 50s, except two (Wood, 58, and Garland, 56).

Merrick Garland is a white man.

It's OK to have opinions, everyone does, but when they are not based upon facts, your credibility suffers.
