There I disagree. There is much malpractice being committed and a lot of it is missed or clients elect not to sue. Today many of my friends who are health providers will tell you not to go into a hospital without an advocate. You cannot trust the hospitals or the docs.

That is not to say there are frivolous law suits because there are but I know that many of them have merit.

One little known fact is that a high percentage of the malpractice is committed by a small percentage of the doctors, but at least in Maryland, when I was involved in this issue, you could not get the docs to agree to crack down on the bad eggs. Another area where I feel some relief is necessary is in Cerebal Palsy birth cases, where doctors are being sued for having to make a tough decision and many large verdicts are being entered out of sympathy for the child. This could be fixed by changing the rules of evidence. Of courst the trial bar resisted that.
