I understand your position and agree with it. However, on re-reading the section in question I don't see where the Advance Care Planning Consultation is a requirement. (Not saying it isn't a requirement, just that it isn't listed as such in the the section I referenced.)

All that the referenced section does is amend Sec. 1861. (Definitions of services, institutions, etc.) of TITLE XVIII—HEALTH INSURANCE FOR THE AGED AND DISABLED of the Social Security Act. It also provides for the updating of the "Medicare & You Handbook" to provide an explanation of advance care planning and advance directives.
