But they aren't mandating living wills, etc. They're just making sure that people know that there are such things available to them. There are a lot of ignorant people out there, after all. Sure, that's a tad overbearing and outside the scope of what any libertarian would consider the mandate of the federal government but not more so than mandating nutrition labels or informed consent re donating a kidney. It's nannyish, sure, but it's hardly reaching new levels of intrusiveness. And it's certainly not a threat in and of itself. It could be used in an intimidating way, but then if medical folks want to intimidate a patient into signing a living will or a DNR, they can do so right now without any new legislation.

I think the fuss about this is way overwrought.
