Such "evidence" may be subtle. In part, it has become the standard way of practicing. When a person being treated in an ER mentions a headache, this person gets a CT scan. In most cases those scans are not needed. That's an example of defensive medicine. It will not be counted by government "researchers".

I have a hard time believing that malpractice, even in more direct costs, is only 2%. Tell this to GYN's who walk away from obstetrics because their premiums go into 100's of thousands.
