Anyway, he wasn't arrested in his house, so that point is moot.

Gates was being belligerent and disorderly, and continued his tirade after being repeatedly warned. That's why he was arrested.

But it's not a crime to be belligerent and disorderly in your own house, no matter how many times you're warned, and no matter who is warning you.


That's why the cop had him step outside. Once outside the cop has a community responsibility to keep the peace.
