As far as I know the term "Rationally Based Evidence" is not a legal term and I am not sure what rationally based evidence exists. I believe he was born in America because McCain's people and the Republicans examined the issue and concluded that it was a non-issue, not because of any evidence other than the contested certificate of live birth. Also, if you follow the Birther argument, or at least my understanding of it, his mother would almost have to have known he was going to run for President when he was born. lj
