The Constitution is a hard boundary. The attempt to make "health care" a "right" where no such right exists under the law is a violation of that boundary. What did the constitution say about stop lights and zoning?

We have a lot of things that aren't in the Constitution. In fact, we have something the Founding Fathers were opposed to, a standing army. The reason? Their ideas about citizen militias was a failure. So you are just hand waving. Again.
