Wow! I thought Texas was bad with it's $250k cap! I think when it's something that will affect you for the rest of your life, they should pay for the rest of your life. Not a fortune, but something.

Economic damages -- i.e., the damages for lost earnings, etc., are not capped. It is the "pain and suffering" award that is capped. So, your statement is really misleading. Not just a little misleading, but it is an Obama lie (that is a lie DESIGNED to mislead).

The 150K cap applies to pain and suffering awards for emergency room cases -- where they're desperately trying to save a life and they're not very likely to cut off the wrong leg and things may be happening quickly.

For a normal surgery, if the wrong leg is amputated, pain and suffering awards can be 500K or even 1.5M depending on who was at fault. But the economic damages -- unlimited.

This is fair. Pain and suffering awards have always been the big ripoff because this is where attorneys earn their money, and generate HUGE awards that require no justification whatsoever.

Over time, this will control the practice of defensive medicine but you can't expect physicians to change their entire thought processes overnight. Already, we're talking about massive savings and they will get larger.
