An inert filler is an inert filler --- not the active ingredient.

Currently patent extensions are allowed (and *have been granted*) for such froo-frau as changing the inert filler, or changing the color of the capsule.

From a societal point-of-view, I regard that as a serious flaw in our system of patenting... (but from the point-of-view of the corporation only wanting to bar competition from his market a while longer, and milk it's cash cow for a couple more Millions or Billions in domestic sales, that's considered a 'good feature' in our system. :-)
