I didn't state that clearly. It was Acorn that told him to pay it back when he could - not the IRS. My fingers don't always type what my brain is telling them. :)

You don't even have to get to the issue of debt forgiveness.

Internal Revenue Code, Sec. 61: Except as otherwise provided in this subtitle, gross income means all income from whatever source derived

Embezzled funds = income
